Terms of Service

1. Service description

Basira ("Basira," "we," "us") provides a database monitoring service ("Service") that collects performance telemetry from your databases via a lightweight agent and presents it through a web dashboard at app.usebasira.com. By using the Service, you agree to these terms.

2. Account terms

• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of your account credentials and API keys.
• You are responsible for all activity that occurs under your account.
• You must be at least 18 years old to use the Service.
• One person or entity may not maintain more than one account.

3. Acceptable use

You agree not to:

• Use the Service to violate any applicable law or regulation.
• Reverse engineer, decompile, or disassemble the Service or agent software.
• Attempt to gain unauthorized access to the Service or its infrastructure.
• Use the Service to monitor databases you do not own or have authorization to monitor.
• Interfere with or disrupt the Service or servers or networks connected to the Service.
• Resell or redistribute the Service without our written permission.

4. Data ownership

You retain all rights to your data. Basira does not claim ownership of the telemetry data collected from your databases. We collect and process this data solely to provide the Service to you. See our Privacy Policy for details on what data we collect and how we use it.

5. Payment and billing

The Service is priced at $29 per monitored database per month. Billing and subscription management are available in your dashboard via Stripe checkout and billing portal. New accounts receive a 14-day free trial. Paid subscriptions include 30-day retention. We reserve the right to change pricing with 30 days' notice.

6. Service availability

We strive to keep the Service available at all times but do not guarantee uninterrupted access. The Service is provided "as is" without any uptime guarantees or service level agreements (SLAs). We may perform maintenance that temporarily interrupts the Service and will provide reasonable notice when possible.

7. Limitation of liability

To the maximum extent permitted by law, Basira shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Service.

The Basira agent operates in read-only mode and does not modify your database. However, we are not liable for any impact the agent may have on your database performance or availability.

8. Termination

You may cancel your account at any time from your dashboard. Upon cancellation, your access to the Service ends at the conclusion of the current billing period. We may suspend or terminate your account if you violate these terms, with notice when practical. Upon termination, all associated telemetry data is deleted within 48 hours.

9. Changes to these terms

We may update these terms from time to time. We will notify you of material changes by posting a notice on our website or sending you an email at least 30 days before the changes take effect. Continued use of the Service after changes constitutes acceptance of the new terms.

10. Governing law

These terms are governed by the laws of the United States. Any disputes arising from these terms or the Service shall be resolved in the courts of competent jurisdiction.
